Please read these Terms and Conditions carefully before using studentrooms.com.au or submitting a tenancy application. By accessing our website or submitting an application, you agree to be bound by these terms.
1. About Us
StudentRooms Pty Ltd (“we”, “us”, “our”) owns and manages student accommodation properties in Adelaide, South Australia, and operates the website studentrooms.com.au. We act as landlord for all properties listed on our website. Our registered office is located at M1 Centre Level 4, 195 North Terrace, Adelaide SA.
These Terms govern your use of our website and, together with your signed lease agreement, your tenancy with us. In the event of any conflict between these Terms and your signed lease agreement, the lease agreement will prevail.
2. Our Properties & Listings
All accommodation listed on studentrooms.com.au is owned and managed by StudentRooms Pty Ltd. We are not a real estate agency, listing platform, or intermediary — we are the landlord.
We take care to ensure that listing information (including room descriptions, photographs, pricing, and availability) is accurate and up to date. However, listings are subject to change without notice. We recommend you confirm all details with us directly before submitting an application.
Publication of a listing does not constitute an offer capable of acceptance and does not guarantee availability.
3. Eligibility
Our accommodation is intended for students enrolled at, or accepted to, a university, TAFE, or other registered higher education institution in Adelaide. By submitting a tenancy application, you confirm that:
- You are at least 18 years of age;
- You are enrolled in or have been accepted to an educational institution in Adelaide; and
- The information you provide in your application is accurate and complete to the best of your knowledge.
4. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Use the website in any way that violates any applicable Australian law or regulation
- Submit false, misleading, or fraudulent information via any form on our website
- Attempt to gain unauthorised access to any part of our website or systems
- Scrape, crawl, or systematically copy content from our website without our written consent
- Introduce viruses, malware, or other harmful code to our website
5. Tenancy Application Process
Applying for accommodation through studentrooms.com.au involves the following steps:
- Online application — you complete and submit an application form on our website, providing your personal details, proof of identity, enrolment information, and references.
- Assessment — we review your application, including conducting reference checks. Submission of an application does not guarantee an offer of accommodation.
- Introduction — if your application is successful, we will contact you to arrange a meeting or introduction prior to lease signing.
- Lease agreement — you will be required to sign a formal lease agreement before any tenancy commences. Your tenancy is governed by that agreement and the Residential Tenancies Act 1995 (SA).
- Move-in — once your lease is signed and any applicable payments have been made, we will coordinate your move-in.
We reserve the right to decline any application without providing reasons, subject to the requirements of the Equal Opportunity Act 1984 (SA) and applicable anti-discrimination law.
6. Lease Agreements & Residential Tenancies
All tenancies are governed by a formal written lease agreement and the Residential Tenancies Act 1995 (SA). By entering into a lease agreement with us, both parties agree to the rights and obligations set out in that Act, including those relating to:
- Minimum lease terms and notice periods
- Condition of the premises at the start and end of the tenancy
- Landlord access to the property
- Rent increases
- Termination of tenancy
If you have questions about your rights as a tenant, you may contact the Tenants Information and Referral Service (TIRS) or the Legal Services Commission of South Australia.
7. Rent & Payments
Rent is payable directly to StudentRooms Pty Ltd in accordance with the terms of your lease agreement. The following general conditions apply:
- Rent is due on the date specified in your lease agreement.
- We will provide you with written receipts or payment records upon request.
- Late payment of rent may result in a notice to remedy breach being issued in accordance with the Residential Tenancies Act 1995 (SA).
- Rent amounts and payment methods will be set out in your lease agreement.
We do not process online payments through our website. Payment arrangements will be confirmed at the time of lease signing.
8. Bond
A rental bond may be required prior to or at the commencement of your tenancy, as set out in your lease agreement. All bonds are lodged with Consumer and Business Services South Australia (CBS) in accordance with the Residential Tenancies Act 1995 (SA). The bond will be returned to you at the end of your tenancy, subject to any lawful deductions for unpaid rent, damage beyond fair wear and tear, or other amounts owed under your lease.
9. Maintenance & Repairs
We are responsible for ensuring our properties are maintained in a reasonable state of repair. As a tenant, you may submit maintenance requests by contacting us at [email protected] or (08) 7070 2560.
We will address maintenance requests in a timely manner, with urgent repairs (as defined under the Residential Tenancies Act 1995 (SA)) attended to as a priority. Tenants must not carry out repairs themselves without our written consent.
You are responsible for keeping your room and any common areas you use in a clean and tidy condition, and for reporting any damage or maintenance issues promptly.
10. Conduct & House Rules
All tenants are expected to behave in a manner that is respectful of other residents and the property. Specific house rules will be provided to you at or prior to move-in. These may cover matters including:
- Noise and quiet hours
- Guests and visitors
- Use of common areas, kitchen, and laundry facilities
- Smoking and alcohol policies
- Rubbish and recycling
Breach of house rules may constitute a breach of your lease agreement.
11. Intellectual Property
All content on our website, including text, images, graphics, logos, and layout, is owned by or licensed to StudentRooms Pty Ltd and is protected by Australian intellectual property laws. You may view and print pages for personal, non-commercial use only. You must not reproduce, republish, or redistribute any content without our prior written consent.
12. Third-Party Links
Our website may contain links to third-party websites for your convenience. We have no control over those sites and are not responsible for their content or privacy practices. The inclusion of any link does not imply our endorsement.
13. Disclaimer & Limitation of Liability
To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental, or consequential loss arising from your use of our website or reliance on information published on it. Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by agreement.
Our website is provided on an “as is” basis. We do not warrant that the website will be uninterrupted, error-free, or that listing information will always be current.
14. Privacy
Your use of our website and submission of a tenancy application is subject to our Privacy Policy, which explains how we collect, use, store, and protect your personal information. By using our website or submitting an application, you consent to the practices described in our Privacy Policy.
15. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our website after changes are posted constitutes your acceptance of the updated Terms. Changes do not affect any rights or obligations under a signed lease agreement.
16. Governing Law
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. Any disputes arising from these Terms or your use of our website will be subject to the non-exclusive jurisdiction of the courts of South Australia. Nothing in these Terms is intended to exclude or limit any rights you have as a consumer or tenant under applicable Australian law.
